I don't think Winston was a choirboy here. 

 But I remember being in college, and I remember being 18 (which is what they both were when this happened).

I think both Winston and the girl made poor choices that evening. That's opinion based on what I've read. If either of them were my kids, I'd be concerned about their actions.

 A girl running out of a bar after drinking and getting into a cab with three guys she's never met before and going back to their apartment at 2 in the morning...that's not how I would expect my daughter to behave. Especially after she'd apparently had sex with her boyfriend earlier that evening.

 My son having sex with a girl he just picked up at a bar in the middle of the night while his two friends are coming and going out of the room...I'd expect more of him than that.

 However, as above, these are 18 year olds. 18 year olds make poor choices sometimes. It doesn't make them bad people, it makes them young and dumb.

 By most accounts, this girl didn't want to pursue this. She cut off contact with TPD. What TPD is supposed to do after she does that, I don't know.  There's a lot of tut-tutting around here, which I find funny considering that Bill Cervone is your equivalent to Willie Meggs. I'd be curious to see board reaction to this article.

The original TPD supplemental claimed her lawyer by phone said she was deciding whether to pursue charges. The same report ended asserting she was not cooperating to support suspending the case. Meanwhile, TPD did nothing to corroborate her identification of Winston beyond asking him for an interview by phone, comparing his apartment complex favorably to her story, and identifying his roomate.

The case was investigated shoddily. To attribute that to her alleged lack of coopration is BS. TPD never came close to due diligence. As a consequence, the victim's fears about the system became true and Winston will be  perceived by many forever as a sexual predator who got away with it.
