The NY Times, a corporation, should have no First Amendment Rights.============================== corps such as Hobby Lobby have rights. The first amendment reads, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." Thus the law that mandated the a company such as Hobby Lobby had to offer contraceptives (or whatever the exact requirement was; regardless, the law prohibited the free the exercise of the owners' religious beliefs) was a direct violation of the owners' individual rights. This is just one area where those on the hard left really have no interest in upholding the Constitution. They don't even understand it. By claiming that a woman's rights have been violated as a result of the company making its decision is to misunderstand the very nature of the Constitution. For starters, the company isn't Congress. The company cannot make laws abridging the free exercise of religion, speech, or the press. It can, however, have its own rules. (Just as you can very lawfully choose not do deal with any people you don't like, for whatever the reason.) That's freedom. But many who go crying to the ACLU don't actually care about rights, freedom, or the Constitution. They only care about twisting the law to impose their way. |
