...hey, if you really want an impartial process and decision maker, file a criminal or civil complaint and use the judicial process.

Problem for the plaintiff's lawyers is that the burdens of proof are more stringent and the protections for the accused more robust.

This lawyer wants to have his cake and eat it too, he wants to take advantage of a more victim-friendly process run by college admins, with lower burdens of proof, but he wants to apply the juducial standards where it helps his case.

This says nothing about the victim or Callaway by the way, if Callaway actually sexually assaulted someone, then let's determine that , kick him off the team and move on.

But I am suspicious that this is one of those grey area cases we see too often, and the facts do not support an actual criminal case, or even a civil one, but the lawyer is going to use the one-sided adverse publicity ( the school cannot comment on either student, so it just has to sit there and take the PR hits) to leverage a settlement out of the university.
