dont believe it applies here. I think the guy had the right to pull his gun when he was forceably pushed to the ground and threatened but when he pulled his gun the threat ended as the guy retreated. It would have been fine by me if he held the guy at gunpoint until the cops came and it would be fine with me if the theat returned with the guy coming back at him in any way The the guy can waste him. Get pushed to the ground  imho you have a right to protect yourself but if the purp retreats your threat is over and it ends there. That is how I read the law and I disagree with the police chief
