Dr. Ford does not have a clear memory of the incident, and she has stated so on multiple occaisions.   Seems she is starting to remember more and more.   The biggest hole in her story is the question of how she got home, though.

I'm not suprised Mitchell says she wouldn't prosecute based on this testimony.  I don't think there is enough there to prosecute....but I wonder if she would request further investigation based on the testimony?  There is no exculpatory evidence at this point.

Regardless, from a confirmation standpoint I am no longer particularly concerned about Ford's allegations.  I don't think they will ever be proven or disproven, and I don't think a qualified Judge should be denied confirmation based solely on allegations like this from when he was in High School.

It is his conduct at the confirmation hearings that has me concerned about his fitness for the bench.
